1. Acceptance of Terms
By accessing and using the zesintu.co.za website (“the Site”) and purchasing products from Zesintu Herbal Products (“the Company”), you agree to be bound by these Terms and Conditions. If you do not agree to all terms, you must not use this Site or its services. We reserve the right to modify these terms at any time, and your continued use constitutes acceptance of the revised terms.
2. Nature of Products & Critical Disclaimer
The herbal products sold on this Site are traditional remedies rooted in South African indigenous knowledge systems. THEY ARE NOT MEDICINES. These products are sold as cultural and traditional wellness supplements only. They are not intended to diagnose, treat, cure, or prevent any disease. Statements regarding traditional uses have not been evaluated by SAHPRA, the FDA, or any other medical authority. You must consult a qualified healthcare professional or registered Traditional Healer before use, especially if you are pregnant, nursing, taking medication, or have a known medical condition. Use of these products is solely at your own risk.
3. User Account & Conduct
If you create an account, you are responsible for maintaining the confidentiality of your login details and for all activities under your account. You agree to provide accurate information and to use the Site lawfully. We reserve the right to suspend or terminate accounts for abusive conduct.
4. Orders, Pricing & Payment
All orders are offers to purchase products at the listed price. We reserve the right to correct pricing errors and to refuse or cancel any order for any reason, including suspected fraud or product unavailability. Payment must be completed in full before an order is processed. We use secure third-party payment gateways; we do not store your full credit card details. You confirm you are authorized to use your chosen payment method.
5. Delivery & Risk
All delivery of products is governed by our separate Delivery Policy. Once a product leaves our premises with the courier, the risk of loss or damage passes to you. Delivery timeframes are estimates only. You are responsible for providing a correct and deliverable shipping address. Failure to accept delivery may result in fees as outlined in the Delivery Policy.
6. Returns, Refunds & Guarantees
Due to the nature of traditional herbal products, we do not offer returns or refunds for change of mind, incorrect ordering, or if a product does not meet personal expectations regarding traditional effects. All sales are final. Refunds will only be considered at our sole discretion if a product arrives materially damaged or is incorrect due to our error, and we are notified within 48 hours of delivery. This does not affect your statutory rights under the South African Consumer Protection Act.
7. Intellectual Property
All content on this Site, including text, graphics, logos, product names, descriptions, and imagery, is the intellectual property of Zesintu Herbal Products or its licensors and is protected by copyright and trademark laws. These Terms and Conditions are governed by the laws of the Republic of South Africa. Any dispute shall be subject to the exclusive jurisdiction of the courts located in South Africa.
